Administrative Sanctions and Discipline History

It is Docketly's compliance policy to verify good standing, administrative sanctions and discipline history with any state bar association an attorney is licensed with at least once a month.

When our Performance Team goes through the process of validating an attorney's good standing they are looking to make sure the attorney is listed as active with their state bar, have no disciplinary issues, have paid their bar dues, etc.

Sometimes our team will find sanctions on an attorney's good standing pull, i.e. bar dues paid late or CLE (Continuing Legal Education) requirements not met. This is NOT considered discipline, however, it is considered an administrative sanction.

If an attorney is found to have administrative sanctions or public discipline history, per Docketly's compliance policy, the attorney's account must be marked to indicate that discovery.

Some Docketly clients have strict policies regarding allowing an attorney with any form of public discipline or administrative sanctions to appear for them. At their request, it has been set up so that if an attorney is marked with one or both of those, they will not be able to accept hearings for that client.

Once admin sanctions or public discipline have been found on an attorney's bar association documentation there is nothing any member of Docketly staff on any team can do to remove the information from the attorney's page. Only the bar association itself can change that. The attorney must contact their state bar to have any discipline or sanctions removed.

PLEASE NOTE: It does not matter how old the discipline history or administrative sanction is. Once it has been found and documented on an attorney's account it cannot be removed.
